Canada's responding submission to the Joint Notice of Motion for Jordan's Principle

On September 22, 2026, Canada submitted its response to the Tribunal, requesting that the 39 orders sought in the Joint Motion be dismissed on the basis that they exceed the Tribunal’s remedial role, duplicate existing processes, and could impede ongoing improvements to Jordan’s Principle service delivery and backlog reduction.

Canada's Notice of Application For Judicial Review concerning the CHRT's August 18, 2026 letter decision

On September 17, 2026, Canada submitted a notice of application for Judicial review of the Canadian Human Rights Tribunal's August 18, 2026 letter decision regarding the Chairperson’s dismissal of Canada's request to reconstitute the three member Tribunal panel hearing the inquiry, with reasons to follow.

Parties and Member Marchildon responses to Canada's request for a new three-member panel

On July 31, 2026, in a submission to CHRT Chairperson Khurana, Member Marchildon opposed Canada's request for a new three-member panel and asked to continue adjudicating the case, either alone or with two newly appointed members, to preserve continuity and avoid delays. 

On August 7, 2026 parties responded to Canada's request and Member Marchildon's submissions concerning the panel composition.

 

Parties responses to Member Marchildon's proposed process to releasing the OFA's full written decision on her own

In an email sent to the parties on July 23, 2026, Member Marchildon invited submissions by August 4, 2026 on whether the parties consented to her proposed approach to releasing the full Ontario Final Agreement (OFA) decision on her own, with any objections supported by relevant case law and considered through a human rights and administrative law lens.
